… A 48-year-old quality control engineer was merging in his pick up truck onto the highway when another vehicle crashed into the back of his truck. His seatbelt latch broke and his knee hit the steering column. He also had a herniated disc in his lower back. A lawsuit was filed against the speeding driver and then settled for her policy limits. A second claim was then made against the engineer’s own insurance company for underinsured motorist benefits. That claim also settled before an arbitration hearing was held. (Most underinsured motorist claims are filed in court and no longer resolved by arbitration.)
